Este trabalho teve como objetivos: i) Analisar as estruturas do Código Florestal de 1965, da Lei de Política Estadual de Florestas do Amapá e da Lei Proteção da Vegetação Nativa; ii) Analisar comparativamente esses três instrumentos legais relativamente a: área de preservação permanente, reserva legal e supressão de vegetação; iii) Indicar necessidade de ajustes da lei estadual e de eventual regulamentação. Para a realização do trabalho foram utilizados os seguintes instrumentos legais: Lei no 4.771/65; Lei estadual no 702/02 e Lei no 12.651/12. Desta forma, foi precedida, a sistematização das leis federais e estadual, para análise das respectivas estruturas, mudanças ocorridas relativamente à APP, RL e supressão para uso alternativo do solo, bem como necessidades de ajustes da Lei estadual. As principais conclusões foram: houve alterações substantivas em relação aos temas mencionados, no que tange as áreas consolidadas, o escalonamento do tamanho da propriedade em módulos fiscais para efeito de recomposição de APP e RL, no estabelecimento de uma área mínima para manutenção de RL (4MF) e ainda a redução de 30 para 20 anos no prazo para recomposição da RL. A PFA deverá passar por ajustes majoritariamente ao longo de quase toda a estrutura, face às alterações promovidas pela nova Lei Federal.
This study had the propose to: i) analyze the structures of the 1965 Forest Code, the Law on State Policy on Forests of Amapa and the Law Protection of Native Vegetation ii) comparatively analyze these three legal instruments regarding: permanent preservation area, legal reserve and vegetation removal; iii) indicate the need for adjustments of state law and any regulation. The following legal instruments were used for realization of the labor: Law no. 4.771/65, State Law no 702/02 and Law no12.651/12. This way, was preceded, the systematization of federal and state laws, for analyze their structures, changes in relation to APP, RL and suppression for alternative land use, and need for adjustments of State law. The main conclusions were: there were substantive changes regarding the subjects mentioned in the terms established areas, scaling the size of the property tax modules to effect recovery of APP and RL, and the establishment of a minimum area for maintaining RL (4MF ) and a further reduction of 30 to 20 years in the period for restoration within the RL. The PFA should undergo adjustments along almost the entire structure, due to the changes introduced by the new Federal Law.
